These Terms of Use (“Terms”) govern your access to and use of the Consolifi website, online forms, applications, tools, portals, and other online services that link to these Terms (collectively, the “Website”).

For purposes of these Terms, “Consolifi,” “we,” “us,” and “our” refer to the entity operating the Consolifi brand and, where applicable, its subsidiaries, affiliates, successors, and assigns.

These Terms apply only to your use of the Website. Additional agreements, disclosures, authorizations, loan documents, consent agreements, or other terms may apply to specific products or services. If there is a conflict between these Terms and a specific agreement relating to a product or service, the specific agreement will control with respect to that product or service.

THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW SECTION 10 CAREFULLY.

1. Changes to the Website and These Terms

Consolifi may update, modify, suspend, or discontinue any portion of the Website at any time.

We may also revise these Terms from time to time. Updated Terms will be posted on the Website with a revised “Last Updated” date. Unless otherwise required by law, changes become effective when posted.

Your continued use of the Website after updated Terms are posted constitutes your acceptance of the revised Terms.

2. Eligibility and User Responsibilities

You must be at least eighteen (18) years old to submit an inquiry or application for financial products or services through the Website.

When providing information through the Website, you agree to provide information that is accurate, current, complete, and truthful.

3. No Guarantee of Loan Approval or Terms

Information available through the Website is provided for informational and eligibility-assessment purposes and does not constitute a guarantee of credit, loan approval, a particular interest rate, loan amount, repayment term, or funding date.

Loan availability, rates, amounts, terms, fees, and eligibility depend on applicable underwriting criteria, creditworthiness, income, state of residence, lender requirements, and other factors.

Checking potential rates or eligibility may involve a soft credit inquiry that generally does not affect your credit score. If you proceed with a formal credit application, a lender or service provider may conduct a hard credit inquiry, which may affect your credit score.

Any final loan terms will be contained in the applicable loan agreement and related disclosures.

4. Intellectual Property Rights

Unless otherwise stated, the Website and its contents—including text, graphics, photographs, videos, designs, software, interfaces, logos, trademarks, service marks, trade names, icons, and other materials—are owned by or licensed to Consolifi and are protected by applicable intellectual-property laws.

Nothing on the Website grants you ownership of any intellectual-property rights belonging to Consolifi or any third party.

5. Limited License

Subject to these Terms, Consolifi grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for personal purposes.

You may print or save reasonable portions of Website content for your own records.

This license automatically terminates if you violate these Terms.

6. User Communications and Feedback

If you voluntarily provide comments, suggestions, ideas, feedback, testimonials, or other non-confidential communications to Consolifi, you grant us permission to use such materials for legitimate business purposes, subject to applicable privacy laws and our Privacy Policy.

Do not send confidential, proprietary, or sensitive information through channels that are not designated for secure transmission.

Personal information submitted through applications, inquiry forms, customer-service systems, or other data-collection tools will be handled in accordance with our Privacy Policy and applicable law.

7. Third-Party Websites and Services

The Website may contain links to websites, applications, platforms, lenders, service providers, or other resources operated by third parties.

These links are provided for convenience and do not necessarily constitute an endorsement, sponsorship, warranty, or recommendation by Consolifi.

Consolifi does not control third-party websites or services and is not responsible for their content, privacy practices, security, availability, products, representations, or services.

Any transaction or agreement you enter into with a third party is solely between you and that third party, except where expressly stated otherwise.

8. Third-Party Loan Eligibility and Financial-Service Providers

Consolifi may work with lenders, loan marketplaces, credit-reporting agencies, technology providers, verification providers, and other third parties to evaluate eligibility, facilitate applications, present potential financial-product options, process information, or provide related services.

Where applicable, this may include services provided through third-party loan eligibility or marketplace providers such as Monevo Inc.

Your use of a third-party service may be subject to that provider’s own terms, privacy policy, credit authorization, electronic-consent agreement, or other disclosures.

Providing information through Consolifi does not guarantee that you will receive an offer or be approved for a loan.

9. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Consolifi and its officers, directors, employees, agents, affiliates, successors, and assigns from claims, liabilities, losses, damages, costs, and reasonable expenses arising from:

  • Your unlawful or improper use of the Website;

  • Your material violation of these Terms;

  • Information or content you submit in violation of another person’s rights; or

  • Fraudulent or unauthorized activity conducted through your account or credentials.

This provision does not require you to indemnify Consolifi for conduct for which indemnification is prohibited by law.

10. Dispute Resolution, Binding Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the extent permitted by applicable law, you and Consolifi agree that disputes arising out of or relating to these Terms, the Website, or your use of the Website will be resolved through binding individual arbitration rather than through a lawsuit before a judge or jury, except for matters that may lawfully be brought in small claims court or matters for which applicable law does not permit mandatory arbitration.

Notice Before Arbitration

Before initiating arbitration, the party asserting a claim must provide the other party with written notice describing:

  1. The name and contact information of the person asserting the claim;

  2. The facts and legal basis of the dispute; and

  3. The specific relief requested.

The parties will make reasonable, good-faith efforts to resolve the dispute informally for at least sixty (60) days after receipt of the notice before arbitration is initiated.

Individual Arbitration Only

Arbitration will take place only on an individual basis.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND CONSOLIFI WAIVE THE RIGHT TO HAVE A DISPUTE HEARD OR RESOLVED AS A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, CONSOLIDATED ACTION, OR PRIVATE ATTORNEY GENERAL ACTION.

Unless both parties agree otherwise, an arbitrator may not combine claims involving more than one individual.

Arbitration Procedure

The arbitrator will apply applicable substantive law and may award any individual remedy or relief that would otherwise be available in a court of competent jurisdiction.

The arbitration award will be final and binding to the extent permitted by law and may be entered as a judgment by a court with appropriate jurisdiction.

These arbitration provisions are governed by the Federal Arbitration Act to the extent applicable.

If any portion of this arbitration provision is found invalid or unenforceable, the remainder will remain effective to the fullest extent permitted by law.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

CONSOLIFI MAKES NO GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, ACCURATE, COMPLETE, CURRENT, OR FREE FROM HARMFUL COMPONENTS.

CONSOLIFI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

INFORMATION AVAILABLE THROUGH THE WEBSITE DOES NOT CONSTITUTE A GUARANTEE OF FINANCING, CREDIT APPROVAL, FINANCIAL RESULTS, OR SAVINGS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSOLIFI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE.

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF DATA, BUSINESS, PROFITS, OPPORTUNITY, OR USE, EVEN IF THE POSSIBILITY OF SUCH DAMAGES WAS KNOWN OR REASONABLY FORESEEABLE.

WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED, CONSOLIFI’S LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Privacy

Your use of the Website is also subject to the Consolifi Privacy Policy.

The Privacy Policy explains the types of information we may collect, how we may use and disclose that information, and the choices and rights available to consumers.

Where separate consent is legally required—for example, certain credit inquiries, electronic communications, telephone calls, or text messages—we will obtain that consent separately.

14. Electronic Communications and Signatures

When you electronically accept agreements or disclosures through the Website, your electronic signature or other electronic indication of assent may have the same legal effect as a handwritten signature, subject to applicable law.

Electronic disclosures, records, and communications may also be subject to Consolifi’s separate Electronic Consent Agreement.

You are responsible for maintaining accurate email, telephone, mailing-address, and other contact information.

15. Telephone and SMS Communications

Telephone calls and text messages are governed by the consent you provide and by applicable law.

Where required, Consolifi will obtain express consent before using automated technology, prerecorded or artificial voice messages, or automated text-message systems.

Consent to receive marketing calls or text messages is not required as a condition of purchasing goods or services where prohibited by law.

Message and data rates may apply. Message frequency may vary.

You may opt out of text messages as described in Consolifi’s SMS Terms of Service and TCPA Consent disclosures.

SMS opt-in and consent information will not be shared with third parties for their own marketing purposes.

16. Security and Internet Communications

Consolifi uses reasonable administrative, technical, and physical safeguards designed to protect information.

However, no website, network, electronic transmission, or storage system can be guaranteed to be completely secure.

You are responsible for maintaining the confidentiality of your passwords, credentials, and devices and for promptly notifying Consolifi if you believe your information or account may have been compromised.

17. Website Use Outside the United States

The Website and services are intended primarily for users located in the United States.

Consolifi does not represent that the Website or its content is appropriate, available, or legally permitted in every jurisdiction.

If you access the Website from outside the United States, you are responsible for complying with applicable local laws.

Consolifi may provide notices through email, postal mail, Website postings, account notifications, or other legally permitted methods.

Notices sent electronically will be considered delivered in accordance with applicable law and the electronic-consent agreements applicable to your relationship with Consolifi.

19. Governing Law

Except where federal law applies or where applicable law provides otherwise, these Terms will be governed by the laws of the State of California, without regard to conflict-of-law principles.

For disputes that are not subject to arbitration, you consent to jurisdiction and venue in an appropriate state or federal court located in Orange County, California, except where applicable law requires otherwise.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without Consolifi’s prior written consent.

Consolifi may assign or transfer its rights and obligations in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or other lawful business transaction.

21. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.

The remaining provisions will remain in full force and effect.

22. No Waiver

Consolifi’s failure to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision at a later time.

A waiver is effective only if made in writing by an authorized representative of Consolifi.

23. Entire Agreement

These Terms, together with any policies, disclosures, consents, and agreements expressly incorporated by reference, constitute the agreement governing your use of the Website.

Specific financial products and services may be governed by separate agreements that supplement or supersede portions of these Terms.

24. Termination

These Terms apply beginning when you first access or use the Website.

You may terminate your use of the Website at any time by discontinuing access.

Consolifi may suspend or terminate your access if you violate these Terms, create a security or legal risk, or misuse the Website.

Provisions that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, dispute-resolution terms, and applicable indemnification obligations—will survive termination.
